You can get it with IE but Firefox just takes you to the domain registration page which, Firefox being a lot more "careful" than IE, usually means there is something dodgy about the code on the site.

What a see you next tuesday!

Just got my small claims court paperwork in the post as he has filed a defence.

He has said that he told me when buying it that any parts with issues should be returned within 3 months and as it is now 7 months he is not prepared to do anything about it..."this is common sence" he says.

We've had numerous phonecalls well passed the 3 month period of him telling me the parts were "on there way", but obviously I dont have recordings of the phone calls and as he never bothers to reply to any emails I have no copies of that either.

BAC!

WTF am I supposed to do now...

It's not clear from your post whether you actually have the parts (whatever they are) or if it's a case of they have never been sent.

The way to approach it clearly depends on which it is.....

It was a bit of both.

When I collected the kit in Jan the clutch kit was missing which he would "send it out next week", it still hadnt been sent out when I filed this claim. Amazingly a clutch kit arrived on my doorstep last week!

The other part of the claim is the crank, the crank that came with it was unusable, i sent him photos in May via email to which he confirmed over the phone he would arrange replacement as he agreed with the problem I raised.

3 weeks later at the end of may he said on the phone he would "chase up the crank"

in June "it should be here next wednesday"

2 weeks later "its probably in hardening and will be here this week"

Then I gave up and went to small claims. At no point did he request anything back, I was obviously more than happy to return the crank with the issue after I had recieved one in good condition but we all know the case is that I would be left with nothing!

If hes running as a company any parts supplied should be fit for purpose. I dont know what he is talking about in relation to 3 months and common sense. Its part of the consumer rights act and you can confirm this by giving them a call.

I have tested this out as I bought a rather expensive cylinder head (over 1k), didnt get round to fitting it for 2.5 years as like any project car I had a lot of other stuff to do. When I did get round to fitting it I found the head to be faulty. I approached the company (not morspeed), mentioned the consumer act and they did the right thing by getting it fixed. Obviously I gave them time and opportunity to fix it as I had left it so long though.

Parts should be of good workmanship up to 6 years, unless used and abused. Thats the rule.

On a separate note. If parts are not up to standard you are entitled to claim a refund if you request one within a reasonable amount of time. A court says a reasonable amount of time is 6 months. After 6 months the supplier has the option to repair or replace. Not refund.

As per David above, the only two comments I would add is that,
1- in my experience, there is no hard and fast rule as to what the appropriate period is for the quality of workmanship, some people argue that it depends on what the item is determines what is reasonable. But if it's never been used and wasn't "fit for purpose" in the first place, that is what you have to demonstrate to the Adjudicator. In the only case I've been involved in with the Small Claims Court - a friend of the wife's was making a claim ironically, about a defective Mini - I wrote a submission to the court on her behalf quoting my engineering qualifications to demonstrate what the garage responsible had said wasn't true. On that basis I would suggest you get a suitably qualified friend to do do something similar. No guarantees it will work but in my case it did, even though I had clearly stated my lack of independance.

2 - It would help if you had a bit more in writing but, at least produce the email you sent and point out the "defendant" (deliberately?) replied by phone to prevent any physical record being produced.

Just my thoughts.

EDIT - just thought, if the clutch kit arrived last week, keep the packaging and any evidence on the packaging as to where it came from to demonstrate (to the SCC) that it only arrived once you lodged the claim...

Cheers chaps, tbh im at work and my wife has read the letter to me over the phone so that just makes it worse that I cannot do anything about it.

I have every email I have ever sent to morspeed as well as a copy of an ignored recorded letter, and all the packaging for the clutch. The packaging doesnt have anything to do with morspeed on it but it will have a postage date stamp.

I cant say he deliberatly contacted me by phone but he certainly ignored my emails.

We only spoke on the phone one in 20 times of me calling.

It would appear, that despite taking it's sweet time, the legal system actually works!

Just on the way home from our hearing, Lewis vs. Morson.

The hearing lasted barely more than 10 minutes amazingly.

Morson turned up dressed in Jeans, and a white tracksuit coat and trainers, with his father, who was similarly dressed. (surely you wear a suit to court?)

Simon had failed to submit statements to the court to back up his defense, and as such he was told his evidence was worthless. He lied claiming to have only recieved the instructions 2 weeks ago, despite sending a letter to the independant engineer regarding the proceedings around 4 weeks ago.

he was however, given the chance to question us on our statements, each detailling our involvment in the case, my own account of how I knew Oli, and how the changes Oli made to the original engine spec were decided upon between us, as well as the two engineers reports from Mintec Mini Spares, and Mike Booth, and independant expert agreed by both parties to inspet the engine. Needless to say, the report written was VERY critical of the engine, stating that it could not be deemed dangerous, as there was no chance it would ever even start!

Surprisingly, Morson had no questions at all for any of us, accepting what we said.

His sole claim seemed to be on the fact that he had no contract with Carol, claiming that as the engine was paid for (in part) by Oli's dad, that the contract was with him.

Clearly he had been terribly misinformed, as the contract he entered into was between Oli Lewis and himself, 3rd party involvement in payment has no effect on those entering into the contract. The judge told him politely that Carol was entirely in the right to sue for the refund of the engine, acting on Oli's behalf.

So, with all that aside, both parties were asked if they had anything else to add, we were fairly happy with how things were going, so had nothing more to add. Morson obviously realised the game was up, so kept quiet.

The judge then went on to order Morson to repay the £4900 for the engine in full, along with all court costs incurred by Carol within 14 days.

Morson accepted this, although when asked if he was able to pay in the allotted time, he claimed he was unable to, due to being unemployed!


So, doubtless to say, 14 days will pass, and we will start proceedings to have the payment inforced, through whatever legal means necessary (IMG:style_emoticons/default/smile.gif)

All in all, happy days I'd say! It's taken almost 2 years since Oli died to get to this stage, but finally things are in our favour.


The world is clearly better off without Morspeed anyway. the whole company was a bad mark on what is otherwise a really awesome little Mini community we have. it's just such a shame he mananged to con so many people over the past few years.


I'll keep everyone updated with how things go over the next few weeks!

I couldnt believe it when morson turned up to court looking like a fucking pikey.

I was ready to get into a full in row with him, but sadly for me, the case was so clear cut that he didn't even try to question anything written in any of our statements.
he's told people on other forums that he's sold the company, but as a sole trader with a non ltd company I didn't think this was possible? I know for a fact that he personally is liable for all debts listed against the company.

Meh. I'm happy, just as soon as we get this money, via whatever means it takes, we can get on and finally finish Oli's mini we've been wanting to get done for almost 2 years!

Great news above.

Just to update you on my case, I was due for "Court Telephone Mediation" which is basically a phonecall between me and Morspeed and a 3rd party person to keep it all civil and resolve the matter without having to goto court.

Believe it or not the Courts were unable to make contact with Morspeed on the phone so is now being passed to the County Court.

In a way I'm not quite so worried about the time its taken now that some justice has come to light from above :)

Just thought I would give a little update as personally I cant stand reading thread that dont seem to come to a conclusion.

In the end I was advised to drop the court case. Due to Simon not being contactable by phone I was asked to pay a £50 fee for the court hearing. Obviously this was yet more money our of my back pocket so I have the courts a call.

They said something along the lines that it would not be worth following this case through as they understand that Simon was claiming unemployment / bankruptcy, which basically meant that even if I did win the case I wouldnt see a penny.

So all in all, that was that and the case was dropped and no surprises they didnt actually hear anything back from Simon at all so if the case did go ahead he wouldnt have been present at the hearing anyway.

I notice that the Morspeed website is still active, and looking on TMF that he was still taking peoples cash for new orders at the end of 2009 and is still stringing at least one person on last month, sounds like the bankruptcy lies are working well for him.

I honestly dont see how he is getting away with still running the company, there must be some kind of legal action that can be brought down on the company to have it closed down for good as we all know that someone new to the scene will come along tomorrow and order something, hand over a few thousand pounds and never see it again.

How did you pay for your engine? Was it cash or on the plastic card? If it was the lager it might be worth talking to Visa / Amex / whoever if you haven't already as they all offer payment protection which is designed to protect you the buyer against this sort of thing.

Speaking to the local crank grinders. He used to do a lot of work for Morspeed. He said that they owe him £2000 and they have taken him to court and won but still haven't got the money.
